On 8 June 2023 the Court of Bosnia and Herzegovina delivered and pronounced a Trial Judgment in the case of Milan Đokić et al.
The accused Milan Đokić, Branislav Trišić, Zoran Tanasić, Žarko Milanović and Mladen Krajišnik have been found guilty that by the acts described in the operative part of the Judgment they committed the criminal offense of War Crimes against Civilians under Article 142 of the Criminal Code of the Socialist Federative Republic of Yugoslavia, which was adopted based on the Law on Application of the Criminal Code of the Republic of Bosnia and Herzegovina and the SFRY Criminal Code.
The Court imposed the following sentences on the accused:
- on Milan Đokić and Branislav Trišić a sentence of three (3) years of imprisonment;
- on Zoran Tanasić, Žarko Milanović and Mladen Krajišnik a sentence of two (2) years of imprisonment.
The accused Milan Đokić, Zoran Tanasić, Savo Mršić, Žarko Milanović, Milivoje Čobić and Milan Marković have been acquitted of the charges, for it was not proven that by the acts described in the operative part of the Judgment they committed the criminal offense of Crimes against Humanity under Article 172 of the Criminal Code of Bosnia and Herzegovina (CC BiH).
The accused have been found guilty that during the armed conflict in Bosnia and Herzegovina, over a time period from the second half of September 1992 and first half of 1994, they acted in violation of the rules of international humanitarian law, namely Milan Đokić, in his capacity as Commander of the Police Station Detachment (SOM Janja), which organizationally belonged to the CSB Bijeljina, Branislav Trišić, as an operative officer at the CSB Bijeljina National Security Service, and Zoran Tanasić, Žarko Milanović and Mladen Krajišnik, as members – police officers at the SOM Janja/SM Janja, in the manner that Milan Đokić aided and abetted in the torture of Bosniak civilians, while Branislav Trišić, Zoran Tanasić, Žarko Milanović and Mladen Krajišnik tortured the Bosniak civilians themselves.
An appeal from the Judgment may be filed with the Appellate Division Panel of the Court within 15 days of the day when a written copy thereof has been received.
